Legionellosis: Managing Your Liability Risk

The consequences of an outbreak of Legionnaire’s disease to a hospitality client can be devastating. The financial cost of performing a Level 2 response often includes taking rooms out of service or potentially closing the facility during remediation, because the high temperatures and chemical treatments traditionally used to kill the bacteria preclude the use of potable water by guests and employees. Additionally, rubber or silicone gaskets and seals in shower heads and faucets must be disinfected or replaced, as the biofilm that builds up on them in plumbing fixtures tends to amplify the growth of Legionella. In addition to the remediation costs and business interruption, other losses include the stigma associated with any adverse media publicity of an outbreak as well as potential third party liability claims for illnesses or deaths sustained by guests contracting the disease. Thus, a vigorous risk management program is crucial for the hospitality client to manage this risk.
