Restaurant Manager Position Found Not H1 Eligible

The United States Court of Appeals for the First Circuit ruled that a restaurant manager position does not qualify for H1 status under US immigration laws. The Court’s decision concludes that Royal Siam did not demonstrate that the restaurant manager position meets any of the four eligibility criteria set forth in the applicable regulation.

The Court also upheld the decision by Citizenship and Immigration Services to deny Royal Siam’s extension petition, even though CIS had previously approved an earlier petition on behalf of the same manager.
