On the Road to Improvement in Costa Rica: The Marinas Law

The existing Marinas Law No. 7744, issued 11 years ago, was a step in the right direction; however, much work is still needed to create a proper dynamic and growing market for the development of marinas in Costa Rica.

Implementation of the Marinas Law has been slow: no such structures have as yet been developed under the new regulation, although several projects are in the outset or under way. Although the Condominium Property Law is applicable to properties in concession, the “dockominium” concept is quite innovative and needs fine-tuning.

Seventh Circuit Awards FMLA Rights To Ineligible Employee

Recently, a U.S. Court of Appeals allowed an employee to pursue the equivalent of full FMLA benefits, despite the fact that he was clearly unable to satisfy the statute’s eligibility requirements.  Interpreting employee handbook provisions, along with statements contained in correspondence from the company, the Court allowed the employee to move forward with his claim for twelve weeks of unpaid leave as a breach of contract, rather than an FMLA claim.

Do you know your state's Rack Room Rate statute?

A rack room rate is the published rate for a room.  Some states have passed laws requiring the room rate to be posted in certain locations.  We have found several statutes, but if you know of others, please send to Diana Singson at Diana@hospitalitylawyer.com.
