    This presentation will discuss procedural, contract and liability issues associated with transactions in Mexico, including choice of law, selecting local counsel, contract issues relating to real estate transactions, personal injury litigation and dispute resolution. The presentation will also discuss how insufficient Costa Rican legislation on condo-hotels has allowed for real estate lawyers and developers to introduce innovative real estate products into the Costa Rican Real Estate market.
  • Doing Business in Europe: Procedural, Contract, & Liability Issues
    Globalization of the world economy means major developing markets for foreign investment opportunities, especially in Europe. Demand for short term lodging for business travelers and tourists is increasing sharply. This session will examine the legal and regulatory environment for developing hotels through the region
  • Doing Business in Canada: Procedural, Contract, and Liability Issues
    This presentation will focus on general considerations when first entering Canada (e.g., jurisdictional differences within Canada, choosing local counsel); legal issues relating to the acquisition and financing of a hotel (e.g., purchase agreement, sales taxes, Competition Act, nominees, title insurance, loan agreement); and operating a hotel in Canada (e.g.,. franchises, food and beverage, liquor and gaming licenses, privacy, labour and employment).

Over the past five years, hotel-condominiums, or "hotel-condos," have become popular financing vehicles among developers and operators of new luxury-oriented lodging projects in major resort and metropolitan areas. Although the most recent surge of activity has been in major urban gateway and resort markets in the U.S., there are now many active projects in key resort markets in the Caribbean and Latin America. If this comparatively complex transaction is properly executed – combined with a bit of good market timing – hotel-condo projects can be highly successful investments for developers, operators and unit purchasers. If not, these projects face the prospect of unsold units, operating headaches and unfulfilled expectations.
